These Terms of Service (“Terms”) govern your use of AZIVAA, operated by AZIVAA LLC, Cypress, CA. Please read them carefully.
1. Acceptance of Terms
By accessing or using AZIVAA ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to all terms, you may not use the Platform. These terms apply to all visitors, users, and customers of AZIVAA.
2. Account Registration
You may create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years of age to create an account or make a purchase. AZIVAA reserves the right to suspend or terminate accounts that violate these terms.
3. Products and Pricing
We reserve the right to modify prices at any time without notice. All prices are displayed in USD unless otherwise stated. We make every effort to display accurate product descriptions and images, but we do not warrant that descriptions, colors, or other content are accurate, complete, or error-free. In the event of a pricing error, we reserve the right to cancel orders placed at the incorrect price.
4. Auctions
AZIVAA offers live auction listings where users may bid on items. By placing a bid, you agree to purchase the item at your bid price if you are the highest bidder at auction close. Bids are binding and cannot be retracted. AZIVAA reserves the right to set reserve prices and end auctions early. Auction winners will be notified by email and must complete payment within 48 hours of auction close.
5. Payments
We accept major credit cards, debit cards, and other payment methods as displayed at checkout. Payment is processed securely through Stripe. You authorize us to charge your selected payment method for your order total. All transactions are encrypted using 256-bit SSL technology.
6. Intellectual Property
All content on AZIVAA — including text, images, logos, and artwork — is the property of AZIVAA or its content providers and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.
7. User Conduct
You agree not to use the Platform for any unlawful purpose, to impersonate any person or entity, to interfere with the operation of the Platform, to submit false or misleading information, or to engage in any activity that disrupts other users' experience. Violation of these conduct standards may result in account termination.
8. Limitation of Liability
To the fullest extent permitted by law, AZIVAA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability to you shall not exceed the amount you paid for your most recent order.
9. Governing Law
These Terms shall be governed by the laws of the State of California without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Orange County, California.
10. SMS Text Messaging
If you opt in, AZIVAA will send automated text messages to the mobile number you provide from (888) 294-8664. Order notifications cover order confirmations, shipping and delivery updates, and made-to-order or auction updates related to your activity. Marketing messages cover new collections, auctions, and offers (up to 6 per month) and are sent only if you check the separate marketing box. Consent to marketing texts is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP at any time to cancel; you will receive one confirmation text and no further messages. Reply HELP for help or email support@azivaa.com. Carriers are not liable for delayed or undelivered messages.
11. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be posted to this page with an updated date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
